I continue to be content to let the Mueller investigation work its way through.

    Which one? Trump-Russia election collusion? Paul Manafort’s 15 year old unrelated dealings? Cohen and a porn star? Or an investigation to be named later?

    Well, this seems like a pretty big escalation.

    At this point I think it’s likely that something criminal will be found on Trump, but that criminality will probably be from before his election.

    So, the question will be, is it appropriate to impeach someone for an offense committed before they took office? I expect the answer will, in most cases, depend on one’s politics and personal view of Trump.

    The domain of impeachment is anything the House of Representatives thinks it is. I seriously doubt that the House will vote to impeach a president with a 38% or greater approval rating and that doesn’t depend on whether the president is the same party as the president or not (much to the disappointment of some Democrats).

    I would also speculate that anyone with business holdings as extensive as Trump’s is guilty of a crime both for Balzac sort of reasons and because the last time it was catalogued the U. S. Code had more than 3,000 crimes. The cataloguing was abandoned as a hopeless task. There are probably 10,000 now.

    I think the greater question is how far afield the investigation will be allowed to go without serious consequences emerging? I’m sort of working on a post on the subject of the raid of Cohen’s offices. It seems to me that one of two things is likely true: either Trump is in serious trouble (if the procedures that are required for such a raid were followed) or Mueller is in serious trouble (if they weren’t).

    Death by a thousand cuts, Mueller as today’s Ken Starr?

    Democrats have been talking impeachment since the day after the election. I take them at their word. Since it only requires a simple majority, if they regain control of the house I think it’s a real possibility.

  • This story is getting increasingly bizarre. It’s now obvious that rousting Cohen was a fishing expedition. If they’re not very, very careful, the entire investigation may get pitched.

    Obvious to you. Looks like they are going after Cohen for fraud and breaking election laws so far. Need to wait to see entire list.

    Mueller would not fish without pretty strong evidence that Trump ordered / knew whatever they think Cohen did, right?

    I am curious for the inevitable book that explains how the decision was made – between Weissman, Mueller, and Rosenberg.

    It is also interesting that Rosenberg decided the matter should not be handled by Mueller but also decided that AG Sessions should not be consulted (or was he?).

    Anyway, I think we won’t really know whether this ends in tears for Trump or for Mueller until July or so.
