The editors of the Wall Street Journal remark on the 5th Circuit’s stay of President Biden’s vaccine mandate:

The court’s opinion takes apart the OSHA mandate every which way—on constitutional, statutory and procedural grounds. The Constitution gives states, not the federal government, the police powers to regulate individual behavior to protect public health and safety. The Administration tried to circumvent this limitation on federal power by conscripting private employers via an OSHA “emergency temporary standard.”

Under federal law, OSHA may bypass for six months the notice-and-comment required by the Administrative Procedure Act to respond to emergencies if it determines that “employees are exposed to grave danger from exposure to substances or agents determined to be toxic or physically harmful or from new hazards” and that such a standard is “necessary to protect employees from such danger.”

As the appeals court explains, OSHA failed to satisfy either condition. OSHA couldn’t show exposure or even the presence of Covid at all covered workplaces. Its “attempt to shoehorn an airborne virus” widely present in society and not life-threatening to most workers “into a neighboring phrase connoting toxicity and poisonousness” is a “transparent stretch.”

The panel also lambastes the mandate as both over- and under-inclusive. On one hand, it covers employees regardless of their risk of exposure and doesn’t exempt those with natural immunity. On the other hand, OSHA sets an arbitrary threshold of employers with 100 workers because they “will be better able to administer (and sustain) the Mandate.”

Even so, the “Mandate flunks a cost-benefit analysis,” the panel notes, because OSHA failed to show that the “protection afforded to workers” would “outweigh the economic consequences” such as unvaccinated workers getting fired or quitting.

As for the alleged emergency justification, some 80% of adults have received at least one vaccine dose. The virus has been spreading in the U.S. for at least 20 months, so it can hardly be defined as a “new hazard” under the law. “OSHA itself spent nearly two months” writing the rule, the panel notes, which suggests it doesn’t perceive a true emergency.

Beyond the statutory violation, the panel held the OSHA rule “likely exceeds the federal government’s authority under the Commerce Clause because it regulates noneconomic inactivity that falls squarely within the States’ police power. A person’s choice to remain unvaccinated and forgo regular testing is noneconomic inactivity.”

which you may notice is very much what I said about the vaccine mandate.

Now let’s repeat my question: why is the administration wasting time on this? Why aren’t they wooing states rather than trying to rule by edict? There’s more to politics than having 50%+1 of the votes and then ruling by edict. Why isn’t Congress changing OSHA’s empopwering legislation and courting Republican Congressmen to support the bill?

    The Democrat Party is a hard-left socialist party with a dominant Marxist wing. Such organizations do not “woo,” they dictate. Such organizations do not submit to any law, they invent “laws” as they go along at their convenience. Pol Pot and the Khmer Rouge are the relevant example.

    I fully expect the Biden regime to ignore the court rulings, and their allies in big business to go along.

    PS. The fact that today’s big businesses align with a socialist regime indicates that we are in a fundamentally Mussolini/Fascist economy.

    I think that Democrats are assuming that and not even trying. They’ve adopted the Homer Simpson strategy: “Trying is the first step on the road to failure.”

    I am not sure the 5th circuit’s view is shared by the other circuits or the Supreme Court (if it reaches that far).

  • Presently, cases have been filed in multiple circuits. Presumably, a lottery will be conducted to determine where the case will be heard. If that decision is different from the 5th Circuit’s the case will undoubtedly go to the Supreme Court.

    Until the lottery is conducted other courts may reach their own decisions. If any of those conflicts, it sets the stage for the case to be heard by the Supreme Court.

    All of that takes time. I return to my question: if it’s an emergency why is the administration wasting time?

    1. They know its not a real emergency. Its a political emergency.

    2. They know with near certainty they have a losing hand. So edict, regulatory overreach or covertly threatened retribution is the only way to go.

    3. They ran on a kill covid platform. They know that polls put covid, inflation, supply and parental choice in schools as the highest issues on American’s minds. (with border and green secondary, but not irrelevant) They know, or have convinced themselves, there is nothing they can do about any issue but covid because it will alienate the progressives.

    4. So that leaves covid. There is no constituency for a virus. So damn the torpedoes. They really have no wins to point to, or potential wins. Infrastructure is being touted as a win. But its 10-30% infrastructure and the balance boondoggle. And there will be no tangible benefit to point to by November 2022. Look up Hail Mary in the football playbook. Next to it you will see covid mandates.

    The statement about the Democrat Party that “such parties don’t woo, they dictate,” is spot on. So many of their policies meet with disapproval from most Americans. But, Dems still disingenuously describe legislative ideas as “for the American people.” They’ve even labeled their election reform bill – one that would make mail-in-voting, ballot harvesting permanent, along with other changes reducing the integrity of voting – “We The People Bill.” The dishonesty of the dem leadership just grows and grows……

    Who knows if VAERS recorded this death as an adverse reaction or not. This man’s dying testimony, though certainly laid the cause of his suffering and death at the feet of the Moderna vaccine, as well as the pharmaceutical company who, because of the EUA status, faces no liability for his death.
