Confirm Jackson

As President Biden’s Supreme Court appointee Ketanji Brown Jackson prepares to be questioned by the Senate, I want to repeat my views on her confirmation. I think that as a general matter a president’s appointments should be confirmed. Therefore barring some severe impediment arising which seems unlikely given her previous confirmations by the Senate, she should be confirmed as a Supreme Court associate justice.

    It has been said the previous confirmations did not do a deep dive into her decisions or district court records. Since this is a more significant appointment, she should be subjected to more scrutiny given, regarding her 25 year long record of leniency towards sex offenders, especially involving children. Given the perimeters of questioning allowed in the Kavanaugh hearings, where unsubstantiated charges of sexual indiscretion during his college years were exploited as reasons to deny him the high court appointment, I think Jackson’s judicial leanings are far more relevant to explore, criticize and possibly reject her admission ticket to the Supreme Court. However, Dick Durbin is trying to keep such controversial records hidden. Instead, the symbolic value of her race and gender are being pushed, which will probably do the trick of assuring her nomination approved.

    Recall, she was very reticent to describe in any way her judicial views in previous hearings. Shorter: her previous confirmations rely on obfuscation and the fact they were for lesser positions. This is the Supreme Court.

    The issue de jour is her view on pedophile related sentencing guidelines. Andy McCarthy’s defense I found thin: Some cases warrant differentiation of young and naive offenders vs hard core pedophiles. However, her track record is monolithic, exhibiting no such subtle considerations. Its worth exploring.

    This all said, I strongly suspect she will be confirmed. And I doubt accused by a mysterious figure of running a prostitution ring in school…….

    The timing is not in doubt unless Jackson says something crazy; Democrats said they want a final vote by Easter.

    The benchmark will be how many Republicans vote for Jackson.
    Kagan got 5 Republican votes.
    Gorsuch got 3 Democratic votes.
    Kavanaugh got 1 Democratic vote.
    Barrett was a party line vote.

    Seems the under/over is 3 Republican votes.

    Will think about this after I resolve the important cheering for St Peters or Purdue dilemma. Not cheering for such an underdog is un-American. Not cheering for the home state team and almost alma mater is unfaithful.
